Beef Australia 2024 Ticket Terms and Conditions of Sale

All tickets are issued by Beef Australia Ltd ABN 34 111 657 160 (also referred to herein as “Beef Australia 2024”, “Organiser”, “Us” or “We”). Tickets are sold on the condition that the ticket holder or the relevant attendee (“You”, “Patron”, “Attendee” or “Ticket Holder”) is bound by these terms and conditions.  By purchasing a ticket or by acquiring a ticket from an on-seller, or by entering any of the Beef Australia 2024 Event venues (“Event”), You agree to be bound by these terms and conditions as well as any other conditions specified on the Beef Australia 2024 website.

General Admission Ticket
1.    General admission tickets allow multiple re-entries for the person, to whom the ticket is registered, to the Event on the
day/date specified on the ticket during opening hours. 
2.    Twilight Pass admission tickets allow multiple re-entries from 3.00pm on the day/date specified on the ticket.
3.    Your admission ticket must be scanned upon entry and exit to/from the Event. 
4.    Entry to the Event will only be allowed by persons with a valid general admission ticket.
5.   Children 16 years and under receive free general admission entry with a paying adult. Free children’s tickets must be selected during the ticket purchase process. A maximum of 4 free child tickets per paying adult limit applies. Children under 16 must be accompanied by an adult. 
6.    Where concessions are applicable, suitable and valid identification must be provided at the time of purchase and upon entry.

Special Events and Functions
7.    The ticket allows entry to the special event or function at the Event stated on the ticket for the person to whom the ticket is registered.
8.     The ticket does not provide general admission to the Event unless otherwise stated on the ticket.
9.    Beef Australia 2024 reserves the right to require the presentation of ID or proof of age on all admission and function tickets and ticket packages that include alcohol.
10.    Entry to the venue hosting the special event or function will only be allowed by persons with a valid ticket for the special event or function stated on the ticket.
11.      Patrons must be 18 years and over to attend functions and special events where alcohol is included in the package.
12.    Tickets purchased at ‘pick-a-seat’ or ‘reserved seating’ functions do not guarantee a specific seat number, only a seat at the table specified.
13.     Beef Australia 2024 reserves the right to move or reallocate individual ticket holders to accommodate table bookings.

Personal Information
14.    You acknowledge and agree that We may collect, hold, use and disclose personal information (as defined in the Privacy Act 1998 (Cth) (“Privacy Act”)) for the purposes outlined in our privacy policy (available on our website), and only if such disclosure will not infringe protections afforded by the Privacy Act.  If personal information is disclosed to Us in connection with the purchase of Your ticket, it will be treated in accordance with the Privacy Act and the terms of our privacy policy.
15.    You agree to comply with the Privacy Act when providing Us with information.

Limitation of Liability
16.  To the fullest extent permitted by law, Beef Australia 2024’s liability for loss or damage to You arising out of or in connection with the Event, whether arising from breach of these terms and conditions, tort (including, without limitation, negligence) or otherwise, is limited to an amount equal to the amount of one general admission ticket (“Liability Cap”).
17.    To the fullest extent permitted by law, Beef Australia 2024 does not accept liability to You for indirect or consequential loss (whether or not We knew or had been informed of the possibility of such loss or damage) for the acts, omissions, or default of Beef Australia 2024 or those providing services in connection with the Event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with the Event.
18.   If You make any claim against Us for loss arising out of or in connection with the Event, liability for Your loss and any amount You may recover will be apportioned having regard to Your respective responsibility for the loss.
19.    Subject to clause 20, We have not made any, and to the extent permitted by law, We exclude all warranties, conditions or guarantees of any nature in respect of the Event. Where warranties, conditions or guarantees or any other rights are implied into these terms and conditions, or otherwise conferred by the Competition and Consumer Act 2010 (Cth) or other laws, and it is not lawful or possible to exclude them, then those warranties, conditions or guarantees or other rights will (but only to the extent required by law) apply to these terms and conditions. To the extent permitted by law, We limit our liability in respect of such warranties, conditions or guarantees to the refund of the ticket cost of the Event.
20.    To the extent permitted by law, the officers, employees, contractors, agents, representatives and advisors of Beef Australia 2024 (“Representatives”) and those of its related bodies corporate shall have no liability to You, whether for breach of contract, tort (including, without limitation, negligence), breach of statutory duty or otherwise, arising in any way out of or in connection with the Event. You agree not to bring any claim (whether in contract, tort (including, without limitation, negligence), breach of statutory duty or otherwise) arising in any way out of or in connection with the Event against any Representatives of Beef Australia 2024 or its related bodies corporate. This will not limit or exclude any liability We may have for their acts or omissions.  This clause is expressly for the benefit of the Organiser’s Representatives and the Representatives of the Organiser’s related bodies corporate, and You agree that each such person is entitled to rely on this clause as if they were parties to these terms and conditions.  We are also entitled to bring proceedings to enforce this clause on behalf of any Representatives.

Venue Entry and Your Obligations
21.    Beef Australia 2024 reserves the right to refuse admission or to eject any person appearing to be intoxicated, under the influence of drugs, showing signs of Covid-19 including a high temperature or a persistent cough, refusing to wear a mask when required to do so (unless they are unable to do so due to an underlaying health condition), otherwise behaving dangerously or inappropriately, or for any other behaviour likely to cause damage, injury, nuisance and annoyance or for failure to comply with the reasonable request or direction of the Organiser.
22.    You agree to take appropriate care for Your health and safety including but not limited to sun protection, hydration and responsible consumption of alcohol. 
23.    You acknowledge and understand that livestock will be exhibited at the Event, and further acknowledge and understand that the behaviour of livestock can be unpredictable. You acknowledge and accept that attending the Event, where livestock is present, is not without risk to Your personal safety (“Livestock Risk”). You acknowledge and accept the Livestock Risk by purchasing a ticket and / or by entering the Event. You further acknowledge and accept that, notwithstanding clauses 16 to 20, to the fullest extent permitted by law, Beef Australia 2024 will not be liable for any injury, loss, death, damage or otherwise, suffered by any Attendee, resulting (directly or indirectly) from the Livestock Risk.
24.    You agree you will obey any directive given to You by a livestock steward, official, judge, Stud Cattle Championship committee member, Beef Australia 2024 Board member or Beef Australia 2024 within and around the Event and in the event You fail to do so, We reserve the right to remove You from the Event and You acknowledge and agree that You will have no recourse to recover the cost of the ticket from Us. You acknowledge this is necessary to mitigate the Livestock Risk.
25.    Smoking is prohibited throughout the Event including open air areas.  The use of electronic cigarettes is not permitted.  
26.    CCTV equipment, static cameras and official photographers are in use around the Event.  Images and footage captured by this equipment may be monitored by Beef Australia 2024 and its Representatives.  Ticket holders and all other persons entering the Venue consent to Beef Australia 2024’s use of this footage and images for future marketing purposes and any other reason Beef Australia 2024 deems appropriate.  
27.    You may capture, record and/or transmit images and footage on social media and the internet provided it is not used for commercial or promotional purposes.
28.    Photographs taken at the Event may be used only for private non-commercial purposes.  For the avoidance of doubt, commercial purposes include licensing, merchandising, memorabilia, or marketing.
29.    Patrons are not permitted to transmit, broadcast, sell, license or otherwise publish, disseminate or reproduce any recordings (including photographic, video or sound recordings) of the Event without Beef Australia 2024’s prior written approval.
30.    If You make, reproduce, or use any recording, data, or image under this condition, You must assign in writing all copyright and intellectual property rights to Beef Australia 2024 or its nominee.
31.    No alcohol or drugs of any type shall be brought into the Event.
32.    With or without Your knowledge, You may be recorded on CCTV or other forms of surveillance in, or in the vicinity of, the Event venue, filmed or photographed individually or in a crowd scene by any person and Your voice recorded at an Event (or any one or more of these things). You irrevocably and unconditionally consent in perpetuity and without compensation to the recording, filming, photographing, transmission and use (or any one or more of these things) by Beef Australia 2024 and its Representative (or either) of Your likeness and voice (or either) by any means (including, audio and visual recordings by television cameras and photographers) throughout the world, to the fullest extent possible, including for official broadcast and promotional purposes (or either).
33.    Scooters (except mobility scooters), skateboards, bicycles, rollerblades, mules, ATVs, motorbikes or any other equipment or vehicles that may interfere with pedestrian traffic are not permitted.
34.    Beef Australia 2024 reserves the right to inspect all bags and containers being brought into the Event and refuse entry to any person carrying any item that in Beef Australia 2024’s opinion is considered dangerous or prohibited.
35.    Prohibited items are not permitted in the Event.  Persons in possession of Prohibited items will not be permitted access to the Event.  
36.    Prohibited items may include but are not limited to professional cameras with detachable lenses and professional recording equipment, selfie sticks, glass bottles & containers, alcohol and illegal substances, items capable of being used as an offensive weapon, hazardous substances including powders, pastes, chemicals, irritants, toxic substances and gas canisters, lasers and laser pointers, items that can be used as  a projectile, banners and posters that have not been approved, fireworks, flares, horns and other noise making devices, pets or other animals other than guide and service dogs (excluding permitted cattle), any vehicle or transportation device that is not authorised, radio scanners, walkie talkies, radio jamming devices, inappropriately messaged clothing, banners, posters or material of any kind, any objects bearing trademarks or other kinds of promotional signs and messages which Beef Australia 2024 believes are for promotional or ambush marketing purposes.

Indemnity
37.    You agree to indemnify and hold harmless Beef Australia 2024, and its Representatives and any related bodies corporate of Beef Australia 2024 and its Representatives, from and against all liabilities, losses, claims, costs, damages or expenses that may result from any legal proceedings arising through any accident, loss or damage whatsoever by third parties (including, without limitation, those based on negligence) arising out of or in connection with Your attendance at the Event (including as a result of the Livestock Risk), and You will indemnify or reimburse Us (at our election) for all costs and expenses (including legal fees on a solicitor/client basis) incurred by Us in connection with any such action, claim or asserted right of action. 

Cancellations, refunds, exchanges, and replacements
38.    All ticket sales are deemed as final transaction.  There will be no ticket returns or exchanges or cancellations or refunds for any reason.

General
39.    Tickets are only valid if purchased through Beef Australia 2024 or an authorised agent.  Tickets cannot be re-sold for commercial gain.  If We have reason to believe that tickets have been re-sold for commercial gain, they will be invalidated, and the Ticket Holder will be refused admission.
40.    Prior to purchasing a ticket, You are required to register for a user account and to nominate a login (email address) and password.  Delivery of tickets will only be made upon the full receipt of payment. Digital tickets will be issued to the registered user account in [February 2024].
41.    Beef Australia 2024 may vary these terms and conditions at any time (and without notice to You) by updating them.
42.    These terms and conditions are applicable to both the sale of tickets and attendance at the Event and its special events and functions held at internal and external venues.   
43.    These terms and conditions apply to both the original purchaser and any subsequent ticket holders.
44.    Beef Australia 2024 reserves the right (without notice to You) to add, withdraw, reschedule, move, and substitute artists, chefs, tours, displays, exhibitions and/or advertised programs, prices, and seating arrangements.
45.    Digital tickets may be printed on paper and used to gain admission if the ticket holder does not have access to a smart phone. 
46.    Beef Australia reserves the right to refuse entry to any person whose printed paper ticket is damaged, defaced or altered in any way or does not have a fully visible, undamaged barcode/QR code.
47.    A failure or delay by a party in exercising a power or right given to it under these terms and conditions does not operate as waiver of that power or right, nor does a single or partial exercise of a power or right prevent any other or further exercise of it.  A waiver by a party of a power or right given to it under these terms and conditions does not affect any other provision of these terms and conditions.
48.    These terms and conditions shall be governed by and interpreted in accordance with the laws of Australia and the State of Queensland and the Courts of Australia or that State shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning these terms and conditions and any matter arising from it.  The parties irrevocably waive any right they may have to object to any action being brought in an inconvenient forum or to claim that those courts do not have jurisdiction.  
49.    Unless otherwise permitted under these terms and conditions, neither party may transfer, charge or otherwise seek to deal with its rights or obligations under these terms and conditions without prior written consent of the other party.
50.    If any provision of these terms and conditions is held to be invalid, in whole or in part, such provision shall be deemed not to form part of and will be severed from, these terms and conditions.  The enforceability of the remainder of these terms and conditions will not be affected.
51.    These terms and conditions constitute the entire and only agreement between the parties relating to the Event.
52.    Any headings used in these terms and conditions are for convenience only and are not part of interpreting these terms and conditions.

Beef Australia 2024 Camping & Glamping Terms and Conditions

All Terms and Conditions below apply to Beef Australia 2024 Tent City Camping and Glamping. Failure to comply with any of the below including any damage caused to campgrounds or property may result in the ticket being confiscated and the guest being asked to vacate and leave the property with no refund issued. 

1.    Glamping ticket holders must arrive and check-in after 10.00AM on Sunday 5 May 2024 and must depart no later than 10.00AM on Sunday 12 May 2024. 
2.    Tent City ticket holders must arrive and check-in after 2.00PM and depart no later than 10.00AM on the check-in and check-out days/dates specified on the ticket purchased. 
3.    Campgrounds will be patrolled 24 hours a day throughout the duration of your stay. Concierge will operate daily, check-in outside of concierge hours must be arranged prior to arrival. Hours will be confirmed on your ticket closer to the event. 
4.    While campground supervisors and security will do their best to ensure a safe and secure environment, we do recommend that guests take the precaution of securing items of value left inside or outside their tent during the day and overnight. The Organiser shall not be liable for any loss, theft, injury or damages sustained entering or on the site. 
5.    All campgrounds are shared between pedestrians and vehicles. Speed limits within campground must always remain at walking pace.
6.    Visitors are not permitted at Campgrounds.
7.    Camping tickets permit entry into the campgrounds only and not into the Beef Australia 2024 event. General Admission tickets must be purchased and presented separately to enter the event. 
8.    Pets or animals are not permitted in campgrounds. Guide dogs and assistance dogs are accepted in accordance with legislation. 
9.    Bookings for Glamping and Tent City offer parking for one vehicle only. Vehicles must be parked in the dedicated parking zones. Vehicles are not permitted within your tent site.
10.    All minors must be supervised by a parent/guardian at all times within campgrounds. Adults/parents are responsible for minors in their care and minors must not be left alone in campgrounds under any circumstances. 
11.    Please be respectful of the enjoyment of others within the campgrounds by restricting noise from electronic devices, music and general conversation between the hours of 9.00PM and 8.00AM.
12.    Vomit, spillage of food or liquids, excessive makeup or fake tan on linen will result in a $100 cleaning fee.
13.    Smoking and vaping is not permitted inside tents or anywhere within the Campgrounds. 
14.    Sites are provided to the booking party for the guest(s) as named on the booking. Campsites must not be sublet or resold by the booking party for commercial gain. 
15.    Footwear must be worn at all times.
16.    Fires and Fireworks are not permitted in campgrounds.
17.    You give your express consent to be included for no fee within any photography and/or video/audio recordings to be used in any media or promotional purpose at any time. 
18.    GLASS, ALCOHOL, WEAPONS, ILLEGAL SUBSTANCES or any item the Organiser considers may be used in an illegal or offensive manner are not permitted in Campgrounds and will be confiscated. Refusal to consent to a search WILL prevent entry to the Campground, without refund. All bags/containers will be subject to a full search. Any prohibited items found will be confiscated and not returned.
19.    No parties or gatherings in Campgrounds, breach of this condition WILL result in eviction without refund. 
20.    GLAMPING: Camping ticketholders must have their photo ID and ticket ready to present to Beef Australia 2024 staff. If you wish to camp with friends, you must select sites next to each other when purchasing camping tickets. 
21.    TENT CITY: Camping ticketholders must have their photo ID and ticket ready to present to Beef Australia 2024 staff. Campsites are allocated at random depending on the tent type you have purchased. To camp together, please select tickets together in a single transaction and we will do our best to position you together, however it is not guaranteed. 
22.    Camping ticketholders must check-in at the concierge office before entering the campground. 
23.    On departure of the campsite please make sure all your belongings, rubbish and vehicles are removed. Any rubbish left behind in tents or around your site will incur a $100 cleaning fee. 
24.    All camping enquiries at the event should be directed to the concierge office within your campground. Any urgent assistance required after hours should be directed to the overnight security. 
25.    Campgrounds will remain open in all weather conditions subject to extreme weather that is deemed unsafe by officials. Refunds will not be provided to guests wanting to move to alternate accommodation due to heavy rain and/or other uncomfortable weather conditions. 
26.    Shoes must be taken off at the door to prevent mud damage on the carpets and bedding. Excessive mud that cannot be removed on bedding and furnishings will result in a $100 cleaning fee.
27.    Do not store any items in the tent which are likely to mark or tear the floor, or otherwise damage any part of the inside of the tents. 
28.    Do not use any lighting, heating, cooking or other gas or electrical appliances of any kind without the prior written consent of the tent providers.
29.    Do not light any fire, candle or other naked flame within or close to the camping equipment.
30.    Do not tamper with the structure or any part of the equipment and in particular not to affix or suspend from the equipment or any item whatsoever without the prior written consent of the tent providers. Please see concierge immediately if you notice any unsecured parts of the tent/structure. 


Rockhampton State High School 2024 Parking Terms and Conditions of Sale

Entry Conditions 

  • No camping on the grounds

  • No glass

  • No overnight vehicles - these will be towed at the vehicle owners expense

  • No smoking on the grounds

  • This is a CAR park - no trailers, campers, trucks, over-sized vehicles.

  • No animals on school grounds

RISK WARNING:

HAZARDS CREATED BY WEATHER, THE CONDITION OF THE CAR PARK, THEFT, MALICIOUS
DAMAGE OR MALFUNCTIONING EQUIPMENT. YOU ENTER THIS CAR PARK AT YOUR OWN

Carpark Terms of Entry (Terms):
- RSHS (and references to we, us or our and similar expressions) means Rockhampton State High School; and
- You means anyone entering this car park (Car Park).

By entering this Car Park, you accept that a contract is formed between RSHS and you on
the basis of these Terms (and no other).

If you do not accept these Terms you and any vehicle in which you entered (Vehicle) must
immediately leave the Car Park. If you do so we will not charge you a parking fee.

  1. You must comply with all rules and directions displayed within the Car Park and any
    directions given to you by our staff.
  2. The Australian Consumer Law (ACL) provides consumers with guarantees that cannot be
    excluded, restricted or modified. These Terms do not affect any rights you have under the
    ACL or any other legal rights which cannot be excluded or modified.
  3. For services that are not services of a kind ordinarily acquired for personal domestic or
    household use or consumption, and/or where you are in trade, you agree that we limit our
    liability, as permitted by the ACL, at our option, to the re-supply of the services or the
    payment of the cost of having the services supplied again.
  4. Subject to clause 3 above and any other legal restriction:
    1. we are not liable for any indirect, special, consequential or economic loss or damage
      whether or not arising from default or negligence by us or our employees or agents; and
    2. To the extent permitted by the ACL, we exclude all terms, conditions, warranties,
      guarantees (either express or implied), and any liability that might apply to us in respect of
      these Terms or anything done under them.
  5. No employee, agent or contractor of RSHS has authority to accept any goods for safe
    custody and we will not be liable for any loss or damage to any vehicle or property alleged
    to have been left by you with us or any employee, agent or contractor, regardless of how
    that loss or damage is caused.
  6. You release us from all actions and demands due to any loss, death, damage or injury
    occurring in the Car Park, including but not limited to, as a result of risk. We are not liable
    for any loss or damage to, without limitation, any vehicle, accessories, contents or personal
    property left with us, in the Vehicle or in the Car Park.
  7. You must pay all parking fees and other costs incurred in relation to the Vehicle being in
    the Car Park, based on the schedule of fees on the Beef Australia website, or any other fee
    arrangement we may have agreed with you. Parking fees are for a single day’s parking and a
    separate electronic ticket is required for each day.
  8. We reserve the right for us and our contractors or agents to enter the Vehicle and to
    move it if we decide that it is reasonably necessary to do so in an emergency or for the safe
    or efficient operation of this Car Park. We may charge you a reasonable amount for moving
    the Vehicle if the need to move it arises:
    1. because you breach these Terms or have caused obstruction;
    2. we reasonably believe the Vehicle is abandoned; or
    3. during the period of retention or sale for non-payment.
  9. You must pay for any damage caused by you or the Vehicle to this Car Park including,
    but not limited to, any damage caused by oil or other substances which leak from the
    Vehicle.
  10. You must indemnify us in respect of all losses, costs (including reasonable legal costs) or
    expenses that we may suffer or incur in respect of:
    1. a breach of these Terms by you;
    2. the Vehicle; or
    3. your use of this Car Park. In the case of paragraphs (b) and (c) your liability
      to indemnify is reduced to the extent that any relevant expense is caused by our negligence
      or default.
    4. This clause does not affect any rights and remedies that may be available to you under the
      ACL or other law which cannot be excluded or modified.
  11. The carpark is open:

    2. Tuesday May 07, 2024 between the hours of 06.00 to 23.00;
    3. Wednesday May 08, 2024 between the hours of 06.00 to 23.00;
